Ireland’s Data Protection Commission (DPC) has launched a formal Grok AI probe, opening a large-scale investigation into Elon Musk’s X over how its AI chatbot processes personal data and generates sexualised images — including images involving children.

The move significantly escalates regulatory scrutiny of Grok AI within the European Union and could expose X to major financial penalties under the General Data Protection Regulation (GDPR).

Grok AI Probe Focuses on GDPR Compliance

The DPC, which serves as X’s lead EU regulator because the company’s European operations are headquartered in Ireland, confirmed that it notified X of the investigation on Monday.

The purpose of the Grok AI probe is to determine whether X complied with its GDPR obligations when processing personal data tied to AI-generated content. Under GDPR, regulators can impose fines of up to 4% of a company’s global annual revenue for violations.

Deputy Commissioner Graham Doyle said the watchdog has been engaging with X Internet Unlimited Company (XIUC) since media reports first emerged about users prompting Grok to generate sexualised images of real people, including minors.

He described the inquiry as a “large-scale” investigation that will assess whether X met its “fundamental obligations” under EU data protection law.

AI-Generated Images Spark Global Backlash

The investigation follows widespread outrage last month when Grok AI flooded X with AI-altered, near-nude images of real individuals in response to user prompts.

Although X announced restrictions designed to prevent Grok from producing such images, reports indicated that the chatbot continued generating similar content when prompted.

The controversy has triggered multiple regulatory responses beyond Ireland. The European Commission opened its own investigation on January 26 into whether Grok was disseminating illegally manipulated sexualised images within the EU.

On February 3, the UK’s privacy watchdog also launched a formal probe into Grok’s handling of personal data and its potential to create harmful AI-generated sexual content.

Regulatory Pressure Intensifies on X

The Grok AI probe comes amid rising tensions between U.S. technology firms and European regulators. U.S. President Donald Trump and members of his administration have criticized EU tech regulation, arguing that fines imposed on American companies amount to a form of taxation.

Elon Musk has also repeatedly objected to EU oversight of online platforms, particularly regulations imposed directly by Brussels governing digital content moderation.

However, EU authorities appear determined to assess whether Grok’s data processing and image-generation capabilities align with GDPR standards, particularly when personal data and sensitive content are involved.

If breaches are identified, X could face significant financial penalties and tighter compliance requirements across the bloc.

As investigations continue in Ireland, Brussels, and the UK, the outcome of this Grok AI probe could shape how AI chatbots are governed in Europe — especially when personal data and generative image tools intersect.
